1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "customer") and Adkroft Industries Pvt. Ltd. ("Adkroft," "Purekin," "Company," "we," "us," or "our"), a company incorporated under the laws of India with its registered office in Ghaziabad, Uttar Pradesh, governing your access to and use of [www.purekin.in] (the "Site") and any purchase of products through the Site, our Amazon.in storefront, or our physical retail stalls (collectively, the "Services").

By accessing the Site, creating an account, or placing an order, you affirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must discontinue use of the Services immediately.

2. ELIGIBILITY

You must be at least 18 years of age and possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872, to place an order on the Site. If you are under 18, you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. ABOUT PUREKIN AND OUR PRODUCTS

Purekin is a brand owned and operated by Adkroft Industries Pvt. Ltd., specialising in wood-pressed (kachi ghani), cold-extracted edible oils, including but not limited to Yellow Mustard Oil, Black Mustard Oil, Coconut Oil, Groundnut Oil, Sunflower Oil, and White Sesame Oil, packaged in glass bottles under applicable FSSAI licensing.

4. ACCOUNT REGISTRATION

To access certain features of the Site, you may be required to create an account. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain and promptly update such information; (c) maintain the confidentiality of your account credentials; and (d) accept full responsibility for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

5. PRODUCT INFORMATION, PRICING, AND AVAILABILITY

5.1 We make reasonable efforts to ensure that product descriptions, images, weights, and pricing displayed on the Site are accurate. However, as our oils are naturally processed through traditional wood-pressing methods, minor variations in colour, viscosity, aroma, or sediment may occur between batches and do not constitute a defect.

5.2 All prices are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST), currently levied at 5% on edible oils under HSN code 15089091, unless otherwise indicated. Prices are subject to change without prior notice, provided that any such change will not affect orders already confirmed.

5.3 We reserve the right, at our sole discretion, to limit order quantities, refuse service, or cancel any order, including in cases of suspected fraudulent activity, pricing or listing errors, or violation of these Terms. In the event of a cancellation due to our error, any amount paid will be refunded in full.

6. ORDERS, ORDER ACCEPTANCE, AND PAYMENT

6.1 Placing an order through the Site constitutes an offer to purchase, which is subject to acceptance by us. An order confirmation email or SMS acknowledges receipt of your order but does not constitute acceptance or guarantee product availability.

6.2 Payments on the Site are processed through our checkout partner, GoKwik, and its integrated payment gateway partners. By placing an order, you authorise the collection of payment through these third-party processors, subject to their respective terms and conditions.

6.3 Full payment is required at the time of order placement, except where we expressly offer cash-on-delivery or other deferred payment options.

6.4 In the rare event that a product becomes unavailable after your order is placed, we will notify you and offer either a full refund or a substitute product of equivalent value, at your election.

7. PROMOTIONS AND DISCOUNTS

Any promotional offers, discount codes, or bundled pricing are subject to specific terms communicated at the time of the offer, and we reserve the right to modify, suspend, or discontinue any promotion at our discretion, without liability, except as required by law.

8. SHIPPING AND DELIVERY

Shipping timelines, charges, serviceable areas, and related terms are set out in our Shipping & Return Policy, which is incorporated into and forms part of these Terms.

9. RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, and order cancellations are governed by our Shipping & Return Policy, which is incorporated into and forms part of these Terms.

10. INTELLECTUAL PROPERTY RIGHTS

10.1 All content on the Site, including but not limited to the "Purekin" and "Adkroft" names, logos, trademarks, product photography, packaging design, graphics, text, brand assets, and the overall "look and feel" of the Site, is the exclusive property of Adkroft Industries Pvt. Ltd. or its licensors and is protected under applicable Indian and international intellectual property laws.

10.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content on the Site without our prior written consent.

11. USER-GENERATED CONTENT

11.1 If you submit reviews, comments, photographs, or other content ("User Content") to the Site or our social media channels, you grant Adkroft a worldwide, royalty-free, perpetual, irrevocable, sub-licensable licence to use, reproduce, modify, publish, and display such User Content for marketing and promotional purposes, in any media, without further compensation to you.

11.2 You represent and warrant that your User Content does not infringe the rights of any third party and is not unlawful, defamatory, obscene, or otherwise objectionable. We reserve the right to remove any User Content at our sole discretion.

12. PROHIBITED CONDUCT

You agree not to:
(a) Use the Services for any unlawful purpose or in violation of these Terms;
(b) Attempt to gain unauthorised access to any portion of the Site, other accounts, or computer systems connected to the Site;
(c) Interfere with or disrupt the operation of the Site or servers/networks connected to it;
(d) Use any automated means (bots, scrapers) to access the Site without our prior written consent;
(e) Engage in any activity that could damage, disable, or impair the Site;
(f) Post false, misleading, or fraudulent reviews or content;
(g) Resell products purchased from the Site for commercial purposes without our prior written authorisation.

13. THIRD-PARTY SERVICES AND LINKS

The Site may integrate with or link to third-party services, including GoKwik (checkout), payment gateways, and social media platforms. We do not control and are not responsible for the content, policies, or practices of any third-party service, and your use of such services is subject to their respective terms.

14. DISCLAIMERS

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR AS REQUIRED UNDER THE CONSUMER PROTECTION ACT, 2019. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

15. LIMITATION OF LIABILITY

15.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADKROFT INDUSTRIES PVT. LTD., ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR PRODUCTS.

15.2 OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR ANY ORDER SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

15.3 NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE INDIAN LAW, INCLUDING THE CONSUMER PROTECTION ACT, 2019, OR IN CASES OF GROSS NEGLIGENCE OR WILFUL MISCONDUCT.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Adkroft Industries Pvt. Ltd., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; or (c) your violation of any third-party right, including intellectual property or privacy rights.

17. FOOD SAFETY AND HEALTH DISCLAIMER

17.1 Our products are food items manufactured under applicable FSSAI licensing and are intended solely for culinary use in accordance with the instructions provided on product labels.

17.2 Any information provided on the Site regarding ingredients, nutritional composition, traditional use, or purported health benefits is provided for general informational purposes only and does not constitute medical, dietary, or professional advice. Such information has not been evaluated to diagnose, treat, cure, or prevent any disease.

17.3 If you have any known food allergies (including to sesame, groundnut, or other allergens), please carefully review the allergen declarations on the product label prior to use. Consult a qualified healthcare professional before making dietary changes, particularly if you have a pre-existing medical condition.

18. FORCE MAJEURE

We shall not be liable for any failure or delay in performance under these Terms resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, government action, labour disputes, courier/logistics disruptions, or supply chain interruptions.

19. DISPUTE RESOLUTION AND GOVERNING LAW

19.1 These Terms shall be governed by and construed in accordance with the laws of India.

19.2 Any dispute, controversy, or claim arising out of or relating to these Terms, including its formation, interpretation, breach, or termination, shall first be attempted to be resolved through good-faith negotiation between the parties.

19.3 If such dispute is not resolved within thirty (30) days, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by Adkroft Industries Pvt. Ltd. The seat and venue of arbitration shall be Ghaziabad, Uttar Pradesh, and the proceedings shall be conducted in English.

19.4 Subject to the foregoing, the courts at Ghaziabad, Uttar Pradesh, shall have exclusive jurisdiction over any matters not subject to arbitration.

20. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

21. WAIVER

No failure or delay by us in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise preclude any further exercise of that or any other right.

22. ASSIGNMENT

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

23. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Shipping & Return Policy, constitute the entire agreement between you and Adkroft Industries Pvt. Ltd. with respect to the Services, and supersede any prior agreements or understandings.

24. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time, at our sole discretion. Material changes will be indicated by an updated "Last Updated" date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
